Permanent injury, time off work and death

Short answerChecked 28 October 2026
Under the Work Injury Benefits Act, permanent disablement is paid at 96 months' earnings × the degree of disablement in the First Schedule (s.30): a worker earning KES 30,000 a month who loses a hand at the wrist (60%) is due 96 × 30,000 × 60% = KES 1,728,000. Time off work is paid at full earnings for up to 12 months (s.28). The First Schedule rates death at 100%; the Director of Work Injury Benefits sets the final award, within minimum and maximum amounts fixed by the Cabinet Secretary.

What next: the WIBA guide covers DOSH 1, the 90-day payment deadline and objections; WIBA Plus adds off-duty cover; employers can get WIBA quotes.

Indicative: the Director of Work Injury Benefits sets the award. The Act caps every payment between a minimum and a maximum fixed by the Cabinet Secretary (ss.28, 30, 34), which this tool does not apply. Medical costs are paid on top (s.47) and are never deducted from the employee.
